Ombudsman Andaluz recognizes citizenship to foreigners

In response to a complaint filed by Andalusia Welcomes against an Order of the regional government, which excluded the access to foreign aid related to access to Information Society and Knowledge, the Andalucian Ombudsman, coinciding with the argument of this entity, it is a broad interpretation of the right to citizenship of the foreign population with reference to the provisions of the Statute of Autonomy of Andalusia.

Andalusia Welcomes The Federation filed a complaint with the Ombudsman of Andalusia to his discomfort over the Order of 9 December 2009 laying down the rules and regulations for access to Technology Services Information and Communication Technology (ICT) between the group of people with disabilities and older people, considering that excluded foreign nationals who have infringed the rights recognized by the Statute of Autonomy of Andalusia, the European Union legislation and the Immigration Act.

In response to the complaint of the company, José Chamizo argues that according to art. 12 of this Statute, " are recipients of public policies both English and foreign nationals held by the residents in Andalucía. Thus foreigners who are residents in any of the Andalusian municipalities have the same rights as English statutory. " And remember, in writing to the Ministry concerned, the need for legal observation of the Statute of Autonomy of Andalusia ending with the recommendation that in future include the immigrant population in the same terms as to be considered in the Andalusian population.

The recognition of the foreign population as having rights and social duties in the same conditions as the English and administrative function of the neighborhood is a great advance "the link to the neighborhood and not nationality access to those rights in Andalusia ", as José Luis Rodríguez Candela, coordinator of Andalusia Welcomes Legal Team.

For this organization, it is essential take steps towards a fully inclusive legislation that involves the recognition of the right to citizenship of the foreign population, regardless of their place of origin . The body recalls the contribution of immigrants to economic growth in recent years and the need to secure their rights regardless of economic conditions.
